荘A鋳,荘B鋳,荘C鋳चिन्हांकित वेळापत्रकात वर्णन केलेल्या घरे, बागा, जमीन आणि परिसर जे काही सर्व भारापासून मुक्त समान समभागांमध्ये पूर्ण संयुक्त मालक म्हणून ताब्यात आहेत, तेव्हा पक्षांनी याचा भाग बनवला आहे . डीडने त्यांच्या मालकीचा समुदाय संपुष्टात आणण्यासाठी आणि उक्त शेड्यूलमध्ये समाविष्ट असलेल्या मालमत्ता स्वतंत्रपणे आणि वैयक्तिकरित्या मालकीच्या, ताब्यात घेतल्या आणि उपभोगण्याच्या उद्देशाने विभाजित करण्यासाठी एकमेकांशी सहमती दर्शविली आहे;

आणि कारण सांगितलेल्या AA., ज्याने आता _____________________________ रोजी पक्षकारांचा समावेश असलेल्या कुटुंबाचे कार्ट जहाज गृहीत धरले आहे, म्हणजेच DD च्या मृत्यूवर, पक्षकारांचे वडील, यांनी सुरू झालेल्या कालावधीसाठी पूर्ण हिशेब सादर केला आहे. सांगितलेल्या तारखेपर्यंत, याच्या तारखेपर्यंत आणि त्याच्या किंवा इतर कोणत्याही सह-भागीदाराविरुद्ध कोणतेही पैसे, दावा किंवा शुल्क देय आणि देय नाहीत;

आणि जेथे ए.ए. रुपये द्यायला तयार आहे . समभाग समान करण्याच्या हेतूने प्रत्येक उर्वरित पक्षांना 500.

(यापुढे प्रथम पक्ष म्हणतात) आणि श्री..... ....................चा मुलगा ....................चा रहिवासी. ........................ (यापुढे दुसरा पक्ष म्हणतात).

तर वर नमूद केलेले पक्ष हे खाली नमूद केलेल्या वेळापत्रकात वर्णन केलेल्या पक्षाच्या समान समभागांचे संयुक्त मालक आहेत.

आणि जेव्हा इन्स्ट्रुमेंटचे पक्ष समान समभागांसाठी पात्र आहेत, तेव्हा वरील गुणधर्म येथे समान भागांमध्ये विभागले गेले आहेत आणि प्रत्येक पक्षाला अनुक्रमे वाटप केले आहेत.

म्हणून आता फाळणीचे हे कृत्य खालीलप्रमाणे साक्ष देते:

1. इन्स्ट्रुमेंटचे पक्ष याद्वारे सहमत आहेत आणि घोषित करतात-

બે ભાડૂતો-ઇન-કોમન વચ્ચે પાર્ટીશનની ડીડ

વિભાજનની આ ડીડ …….. ના દિવસે .. AB વચ્ચે, વગેરે ……. પર કરવામાં આવે છે. બીજા ભાગનો પ્રથમ ભાગ અને સીડી વગેરે.

જ્યારે અહીં પ્રથમ અને બીજી અનુસૂચિમાં ઉલ્લેખિત મિલકતો એક ઓપી, વગેરેની હતી ;

અને જ્યારે કથિત ઓ.પી.નું અવસાન થયું.... તેમની પાછળ કથિત એબી તેમના પુત્ર અને ઉક્ત સીડી, તેમની પુત્રીને તેમના એકમાત્ર વારસદાર તરીકે છોડી ગયા જેમણે અનુક્રમે 2/3 અને 1/3ના શેરમાં મોહમ્મદન કાયદા હેઠળ આ મિલકતો વારસામાં મેળવી હતી . .

અને જ્યારે પક્ષકારોએ તેમની ઈચ્છા વ્યક્ત કરી છે અને ઉપરોક્ત મિલકતોને પછીથી દેખાય તે રીતે વિભાજિત કરવા સંમત થયા છે:

અને જ્યારે પક્ષકારો વચ્ચે સહમતિ બની છે કે વિભાજનની સમાનતા માટે ઉક્ત એબી દ્વારા આ સીડીને રૂ . ……………… ચુકવવા જોઈએ.

હવે આ ખત નીચે મુજબ સાક્ષી છે:

1.     કન્વેયન્સ (1) ઉપરોક્ત કરારના અનુસંધાનમાં અને ઉપરોક્ત સીડી દ્વારા ટ્રાન્સફરની વિચારણામાં આ પછીથી એબી એ સીડીને અનુદાન આપે છે અને જણાવે છે કે મિલકતમાં આ એબીનો અવિભાજિત બે-તૃતીયાંશ હિસ્સો અને વ્યાજ અનુસૂચિ A માં અહીં વર્ણવેલ છે જેમાં ……….. એકર છે અને આ સાથે જોડાયેલ યોજના પર દર્શાવવામાં આવ્યું છે અને તેના પર તેની સીમાઓ સાથે લાલ રંગની તમામ ઇમારતો સાથે દર્શાવવામાં આવી છે અને હવેથી તે સીડીમાં ઘણી સંખ્યામાં રાખવામાં આવશે.

ડીડ એવિડેન્સિંગ ઓરલ પાર્ટીશન

વગેરે , પ્રથમ ભાગ, સીડી વગેરે વચ્ચેના મૌખિક વિભાજનને રેકોર્ડ પર મૂકે છે ; બીજા ભાગના અને ત્રીજા ભાગના EF વગેરે, સ્વર્ગસ્થ જીએચના પુત્રો, ………………..રોડના રહેવાસી, શહેરમાં………..

જ્યારે જીએચનું ……………….. .2000 ના દિવસે ઇન્ટેસ્ટેટ અવસાન થયું હતું , ઉપરોક્ત નામના ત્રણ પુત્રોને છોડીને, જંગમ અને સ્થાવર મિલકતોના હકદાર, જીએચ દ્વારા છોડી દેવામાં આવ્યા હતા.

અને જ્યારે કથિત ત્રણ પુત્રો વચ્ચે મતભેદ અને વિવાદો ઉભા થયા જેમણે તેમની વચ્ચે મિલકતો વહેંચવા અને વહેંચવા માટે ……………… ના KL નો સંપર્ક કર્યો.

Deed of Partition with a Cash Payment for Equalization

This Deed of Partition is made on the ……… day of ………… between KK, resident of ……………………. of the first part AND RK, resident of ………………………. of the second part AND SK, resident of ……………………………. of the third part.

Whereas the parties hereto being in possession as absolute joint owners in equal share free from all encumbrances whatsoever the houses, gardens, lands and premises made part of this deed have agreed with each other to put an end to their community of ownership and to divide the properties contained in the said Schedules for the purposes of the same being separately and individually owned, possessed and enjoyed ;

And Whereas the said KK, who assumed Karataship of the family now comprising of the parties hereto on ……………, that is, on the death of JK, father of the parties hereto, has rendered full account for the period beginning with the said ………………, to the date hereof and no money, claim or charges are due and owing by any of the parties hereto against him or any other cosharers.

And Whereas KK is prepared to pay a sum of Rs. …………. to each of the remaining parties for the purposes of equalising the shares.

Deed of Partial Partition of Hindu Undivided Family Property In Respect of Certain Property only While The Rest of Hindu Undivided Family Continues to be Joint

This Deed Fo Partial Partition is made on the …….. day of ………………, BETWEEN SN, son of ON, resident of ………………………………. (hereinafter called the first party’) of the first part, AND PN, son of ON, resident of ………………………., (hereinafter called ‘second party’) of the second part, AND PM, son of ON, resident of ………………………………. (hereinafter called the ‘third party’) of the third part.

Whereas the said ON and his son the said SN, PN and PM form a Hindu undivided family, of Bombay and Poona, are desirous to partition the properties referred to in Schedule appointed to this deed without serving their Hindu undivided family Status.

NOW THIS DEED WITNESSES as follows :

1.     Conveyance

1.     That the properties which the above parties are desirous to partition without severing their Hindu undivided family status are three houses in the city of Poona of equal valuation more fully described in the Scheduled appended with this deed.

2.     That on the advice of the friends of the family the parties agreed to divide the said property amicably in lots and with this object the said ON prepared four equal lots of the said joint property and lots were accordingly drawn and the lots mentioned in the First, Second, Third and Fourth Schedules were drawn by the said ON, SN, PN and PM respectively.

3.     That in pursuance of the aforesaid agreement the parties hereby agree and declare that the said ON, SN, PN, PM shall here in forth be separate owners of the properties mentioned in the each of them shall hold and enjoy the property so allotted to him in severalty and free and discharged from all claims and demands of the others thereto or concerning therewith, and all other properties belonging to the Hindu undivided family shall remain joint and intact as before as no partition of the Hindu undivided family has taken place amongst the parties.
