(which expression shall mean and include unless, excluded by or repugnant to the context his heirs executors, successors, legal representatives, administrators and assigns) of the OTHER PART.
WHEREAS the First Party is the absolute Owner of the land measuring _____ Kathas, appertaining to and forming part of Plot No. ____, recorded in Khatian No. _______ of Mouza ? ____________, J.L. No. _________ situated at _________________________________(Address with pin code) and he is possessing and enjoying the said land in his khas, actual and physical possession having all permanent, heritable and transferable right, title and interest therein.

WHEREAS the First Party, after acquiring the said land in manner as stated above, is enjoying and possessing the same without any intervention or disturbance from any corner whatsoever, free from all encumbrances and charges whatsoever and is having permanent and transferable right, title and interest therein.

WHEREAS the First Party / Owner of the One part herein is desirous of developing his above mentioned land, as fully and particularly described in schedule below and accordingly sanction building plan to construct G+_____ storied building bearing Plan No. _______ from __________________________(Block/Corporation).

WHEREAS the Second Party/ Contractor is engaged in the business of construction and has got the experience in holding to construction work of the building and the First Party / Owner being acquired with the Second Party / Contractor, approached the Second Party / Contractor and proposed to embark on the project of construction of G+_________ storied building on his below scheduled land under certain terms and conditions.

WHEREAS in order to avoid disputes, differences, dissensions and misunderstandings that may crop upon between them, the parties hereto have deemed it proper and expedient to draw up an Agreement embodying the terms, conditions and stipulations agreed upon by and between them and this agreement is according drawn up and executed by and between them.
NOW IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWSP:-
- This agreement shall be deemed to have been commenced on and from the date of execution of these presents for all intents and purposes.
- That the Second Party / Contractor shall construct the G+_____ storied building and shall complete the construction within _______(In word) years.
- That the First Party / Owner shall co-operate with the Second Party / Contractor in each and every matter in respect of the proposed construction work of the said G+_____ storied building of the first party.
- That the Second Party has to construct of the said G+_____ storied building under follows terms and manners:-
- That the Second Party / Contractor shall develop G+_______ storied building as per sanctioned building plan.
- The second party shall be entitled to receive a sum of Rs. _______ per square feet for the construction of ground floor and Rs. _______ per square feet for the construction of _____, _______ and _______ (Number of floor) floor area.
- The second party shall receive the weekly payment from the first party for the appointed masons, workers, labours etc. during the construction s of said building under the following rates:-
- Rate of Masons Rs. ______ per day
- Rate of Male Labourers Rs. ______per day
- Rate of Female Labourers Rs. _______ per day
- The full and final payment shall be made by the first party to the second party after completion of the said G+______ storied building.
- The second party shall be liable to pay any compensation if any incident occur with the mason, labourers to the site.
- That the first party has convents under following manners.
- The first party shall arrange and available the building materials to construct his G+______ storied building within stipulated time.
- The first party shall handover the copy of building plan for construction his G+_______ storied building and if any change in the construction work of the building than the first party shall revised the same by appointing any engineer.
- The first party shall not be liable to pay any compensation in case of injury sustained by any mason or labourer to the site of construction of said building.
- That the second party shall not claim and or demand any money on his account with the first party during the construction work and all the measurement of construction work shall be made after completion of construction work of G+______ storied building.
- That during the construction work of G+_____ storied building of the first party, the second party shall always supervised the construction work sincerely, honestly and faithfully and run the work with the consult of the first party.
- That this Agreement is made at the sweet will of both the parties and without any pressure from any corner whatsoever.
SCHEDULE OF LAND
All that piece of parcel of land measuring ______ Kathas, appertaining to and forming part of Plot No.______, recorded in Khatian No. _____ of Mouza- ___________, J.L. No. ___________, situated at ___________________________________(Address with pin code).
IN WITNESS WHEREOF both the parties in good health and conscious mind have set and subscribed their respective hands on this AGREEMENT on the day, month and year first above written.
